The President of the High Court and Head Judge Peter Marti stated still sitting in the chair of the head judges in the courtroom Rudolf Elmer after closing stated the public hearing on Aug 23rd, 2016 that
1) « you are not a whistleblower »
2) « your are an ordinary criminal »
3) « you did everthing for our own benefit » etc.
Such remarks caused that other judges and even presidents of Swiss Courts in the magazine of the judges called « Plädoyer » made statment that Head Judge Peter Marti should not have made those statements related to Rudolf Elmer, he is now risking that the verdict will not be accepted by the Federal Court and also a criminal investigation.
Rudollf Elmer filed a complaint last week against the head judge Peter Marti reported the well known newspaper Neue Zürcher Zeitung and many other newspapers in Switzerland.
Considering all those recent decisions and facts it is now to be considered if the courts of Zurich are morally corrupt. A clear indication is to be found on Rudolf Elmer webpage but also and more importantly on Tax Justice Network

A court in Zurich handed Rudolf Elmer, a whistle-blower, a 14-month suspended prison sentence for threatening his former employer, Julius Bär, a private bank. However, he was acquitted of the more serious charge of violating Swiss banking-secrecy laws. The ruling sets an important precedent, since it indicates that Switzerland’s famously strict confidentiality laws do not protect foreign trusts and companies that hold Swiss accounts.

Die Doku « Offshore: Bankgeheimnis und Elmer » macht Premiere beim Schweizerischen Fernsehen SRF I, Freitag, 19. August 2016, 22.25 h.
Das Interview mit Mister Swiss, Werner Schweizer ist lesenswert und zeigt Hintergründe zum Dokumentarfilm.
Die öffentliche Urteilsverkündung am Zürcher Obergericht in der Causa Elmer inklusive WikiLeaks ist auf Dienstag, 23. August 2016, 1400 im Züricher Obergericht angesagt.
Der Hurrican-Laptop, der in der Doku gezeigt wird, ist weiterer Sprengstoff, denn sollte Rudolf Elmer freigesprochen werden, was die Sonntagszeitung in ihrem Bericht andeutete, dann sind die Cayman Daten eben nicht vom Schweiz. Bankgeheimnis geschützt! Das wäre eine Katastrophe für die Bank Julius Bär & Co. AG, Zürich und würde die Kunden massiv verunsichern und den Schutz des Bankgeheimnis nochmals in Frage stellen! Der Krimi geht damit weiter! |

De Zurich à l’île Maurice, en passant par Londres et Paris, j’ai suivi pendant sept ans la vie mouvementée de Rudolf Elmer, un ex-banquier suisse pionnier des fuites de données financières sur Internet. Dès 2008, bien avant la vague OffshoreLeaks, LuxLeaks et SwissLeaks, Elmer entame la publication, sur le tout jeune site WikiLeaks.org, de données clients ultraconfidentielles provenant de la sulfureuse filiale aux îles Caïmans de la banque privée suisse Julius Bär. Une mine d’or qui sera exploitée par plusieurs administrations fiscales de la planète, dont le fisc belge. Pour Elmer, les conséquences seront très lourdes: filatures et harcèlement par des détectives privés, détentions préventives pour suspicion de violation du secret bancaire suisse, procès à répétition, acharnement médiatique, exil, chômage, burnout…
Cette histoire de secrets aux allures de thriller, je la raconte dans «A Leak in Paradise (L’homme qui voulait détruire le secret bancaire)», un film documentaire qui sera projeté au cinéma Le Parc à Liège ce mercredi 13 janvier à 20h. A travers la descente aux enfers de Rudolf Elmer et sa famille, j’ai tenté de donner à voir la puissance institutionnelle de ce fameux secret bancaire et son impact concret sur l’existence de ceux qui tentent de le défier. Bien sûr, Elmer n’est pas un chevalier blanc. Ses motivations sont diverses et complexes. Elles évoluent dans le temps. Le «lanceur d’alerte» a sa part d’ombre que le film explore également…
Le film a par ailleurs l’honneur de faire partie, dans la catégorie «Grand reportage et investigation», de la sélection officielle du Festival international de programmes audiovisuels (FIPA) qui se tiendra du 19 au 24 janvier à Biarritz. Il y sera projeté le mercredi 20 janvier à 14h45 au Théâtre du Casino Municipal, en présence du jury, puis le vendredi 22 janvier à 15h30 à la Salle Gamaritz de la Gare du Midi. Près de 1.200 films issus de plus de 70 pays s’inscrivent chaque année pour participer au FIPA et seules quelque 130 œuvres sont présentées en compétition et hors compétition, dans neuf catégories. On est donc déjà vraiment ravis d’avoir franchi ce cap!
